A Chesterfield man riding a moped unlicensed while carrying a passenger with no helmet and “clearly under the influence of alcohol” refused police a breath sample.

Jake Fox, 27, told town magistrates he had lost his job the same day, adding “it was stupid what I did and I regret it”.

Chesterfield Magistrates Court heard how on June 23 following police saw Fox’s passenger “jump” off his moped on High Street, New Whittington.

The defendant, who had no legal representation, told magistrates: “I know what I’ve done is wrong - which is why I didn’t want to waste anyone’s time with a solicitor.”

Fox, of Shaw Street, Whittington Moor, admitted failing to provide a specimen, driving uninsured and without a licence.

He was banned from driving for 20 months and handed a 12-month community order with 80 hours unpaid work, court costs of £85 and a £95 victim surcharge.
